1. Acceptance
By accessing or using Orbitarium ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Operator and Contact
Orbitarium is operated by the project owner. Legal and service notices may be sent to hello@orbitarium.io. Additional operator details will be provided where required by applicable law or a written commercial agreement.
3. Description of Service
Orbitarium is a browser-native real-time 3D motion engine built with WebGPU, Rust, WebAssembly, and custom GPU pipelines. The Service allows you to create, save, import, export, view, and share live Scene Programs through the App and Player.
4. Free Service, Paid Services, and Custom Work
The public browser app may be offered free of charge. Custom scenes, embedded visual worlds, commercial integrations, consulting, support, licensing, or production work are not included in the free Service unless agreed in a separate written proposal, order, statement of work, or contract.
For paid or custom work, the written commercial agreement controls pricing, payment schedule, delivery scope, revision rounds, acceptance criteria, cancellation, refunds, support, usage rights, exclusivity, and deadlines. If no separate written agreement exists, no paid deliverable, exclusive license, ownership transfer, service-level guarantee, refund right, or maintenance obligation is created.
5. User Accounts
Certain features require authentication via Google Sign-In. By signing in, you authorize Google to verify your identity. Your Google credential is sent to our activation endpoint only to verify sign-in and issue a signed Orbitarium activation token. We do not maintain user profiles or a user database.
6. License to Use Orbitarium
Subject to these Terms, you receive a limited, revocable, non-exclusive, non-transferable license to access and use Orbitarium through the official website and player interfaces. You may not sell, sublicense, host, mirror, resell, white-label, or commercially exploit the Service, engine, player, hosted assets, or interface unless we agree in writing.
Unless a written commercial agreement says otherwise, Orbitarium retains all rights in the underlying engine, code, design system, shaders, tooling, trademarks, and platform. You retain rights to your own original inputs and scene choices, subject to the license needed for Orbitarium to render, store, transmit, share, and display them when you use the Service.
7. Acceptable Use and Security Rules
You agree not to, and not to allow any other person or automated system to:
- Use the Service for any unlawful, harmful, fraudulent, abusive, or deceptive purpose.
- Attempt to gain unauthorized access to the Service, accounts, activation tokens, endpoints, systems, networks, devices, data, or any non-public area.
- Probe, scan, test, exploit, or attempt to exploit vulnerabilities except as expressly allowed under the Responsible Security Research section below.
- Bypass, disable, overload, or circumvent authentication, activation, access controls, technical limits, body-count limits, rate limits, cache controls, or security measures.
- Interfere with the availability, integrity, or performance of the Service, including denial-of-service attacks, excessive automated requests, scraping, bot traffic, cryptocurrency mining, or resource-exhaustion attacks.
- Upload, share, transmit, or link to malware, malicious Scene Programs, phishing content, credential-harvesting flows, exploit payloads, or content designed to damage, disable, or compromise another system.
- Use Orbitarium, shared links, player links, or hosted assets as attack infrastructure against any third party.
- Reverse-engineer, decompile, disassemble, extract source code, extract secrets, or derive non-public implementation details from the Service, except where applicable law expressly allows it.
8. Responsible Security Research
If you believe you have found a vulnerability, contact us at hello@orbitarium.io with enough detail to reproduce the issue. Testing must be limited to your own browser, account, scenes, and data, and must not degrade the Service or affect other users or third-party systems.
You are not authorized to access, modify, delete, retain, or disclose data that is not yours; bypass payment, activation, authentication, or access controls; perform social engineering; send spam or phishing; deploy malware; continue testing after being asked to stop; or publicly disclose exploit details before we have had a reasonable opportunity to investigate and fix the issue. Orbitarium does not offer a bug bounty or reward unless we agree to one in writing.
9. Enforcement and Consequences
If we believe that you have violated these Terms, abused the Service, attempted unauthorized access, or created risk for Orbitarium, users, infrastructure, or third parties, we may act immediately with or without notice.
Possible actions include limiting, throttling, blocking, suspending, or terminating access; revoking activation tokens or shared links; removing abusive scenes or content; preserving and reviewing technical evidence; notifying hosting providers, affected third parties, law enforcement, or regulators; and seeking injunctive relief, damages, reimbursement of investigation and remediation costs, or any other remedy available under law.
10. Performance and Device Load
Orbitarium uses WebGPU and can load your GPU, CPU, memory, battery, and cooling system, especially with large scenes, long trails, high speed, or high render settings. Choose limits appropriate for your device.
11. Shared Scenes and User Content
Shared Scene Programs and URLs may expose scene parameters, names, colors, and settings to anyone with the link. Do not place private, confidential, or sensitive information in scenes or scene names.
12. Local Data
Preferences, cache, undo history, and local scenes may be lost if you clear browser data, use the cache-clear button, switch devices, or browser storage is unavailable. Orbitarium cannot restore local-only data.
13. Third-Party Services and Links
Orbitarium may depend on third-party services such as browser vendors, Google Sign-In, Cloudflare, hosting providers, email providers, and payment or collaboration tools used for custom work. Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party websites, services, outages, policies, or security practices.
14. Age Requirements
You must be old enough to use online services and consent to these Terms under the laws of your country. If you are under the age of legal majority, you may use Orbitarium only with permission and supervision from a parent or legal guardian. Orbitarium is not intended for children under 13 and does not knowingly collect personal information from children.
15. Intellectual Property
All code, design, and content of Orbitarium are the property of the developer. Scenes you create are yours. By sharing a scene via URL, you grant other users a non-exclusive right to view and remix it.
16. Indemnity
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless the developer from claims, liabilities, damages, losses, and expenses arising from your use or misuse of the Service, your shared scenes or content, your violation of these Terms, your violation of law, your violation of third-party rights, or your security abuse.
17. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted access, accuracy of simulations, or fitness for any particular purpose.
18. Limitation of Liability
To the maximum extent permitted by law, the developer shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
19. Termination
We reserve the right to suspend or terminate access to the Service at any time, for any reason, without notice.
20. Governing Law and Disputes
Paid work, enterprise use, exclusive rights, or production integrations should specify governing law, venue, dispute process, and tax treatment in a separate written agreement. If no separate agreement applies, applicable mandatory law determines the competent courts or authorities.
21. Changes to Terms
We may update these Terms by publishing the current text with a revised effective date. Continued use after publication constitutes acceptance of the updated Terms.
